FCA funds landmark franchise law case

The Franchise Council of Australia is supporting the High Court appeal of a franchisee in a case that is critical to franchise law in Australia.  The FCA is asking its members to donate money to help fund a franchisee who is appealing a NSW Court of Appeals decision that a franchise agreement with Master Education Services Pty Ltd is illegal because the francisor did not recieve a written confirmaiton that the franchisee has recieved, read and understood the Disclosure Document and the Franchise Code of Conduct.  The FCA believes that this case needs to be heard in the High Court to establish clarity about the franchise law.
 

“We believe a High Court ruling is necessary to restore certainty for the sector,” said FCA Executive Director Steve Wright.
 

“The ramifications of this case are of serious significance for the franchise sector Australia-wide. It is the biggest single legal issue the FCA has faced in its 25-year history,” he said.
